The Official Feed and Food Controls Regulations 2007 are now in force in the UK. These Regulations update and replace the Official Feed and Food Controls Regulations 2006. You will need to amend authorisations if you have specifically listed the regulations. Links to the legislation are here.
The new regulations introduce several changes, however, the principal purpose of replacing the 2006 SI is to give effect to Article 28 of Regulation (EC) 882/2004 on official controls. This requires that the competent authorities charge feed/food business operators for expenses arising from ‘additional official controls’. This is likely to be in response to a major incident such as a food recall and is unlikely to be relevant at import. The FSA have issued guidance on this which is available on the FSA website.
Other changes introduced by the regulations include:-
Changes the wording of the prohibition for the introduction of certain feed and food products - so that HMRC are able to target imports of controlled NAO foods, the offence is related to the person
introduction a detention notice under regulation 30, and make it an offence to fail to comply with the notice under regulations 39 (d)
The definitions of relevant food law have been revised under schedule 3 to include materials and articles in contact with food
Regulations regarding the control of high risk food and feed products have not been brought in as they are still under discussion in Europe.
